On September 22, 2009, the Minister of the Environment approved the
Consolidated Municipal Hazardous or Special Waste (MHSW) Program Plan.
It will go into effect on July 1, 2010.

Who is responsible for running this program?
As directed by the Minister of the Environment, Stewardship Ontario will operate the Consolidated MHSW Program. Companies that are MHSW Phase 1 stewards will continue to be obligated in that program until the Consolidated MHSW program becomes effective on July 1, 2010.
Who is obligated under the Consolidated MHSW Program?
Any company that is a brand owner or a first importer of any of the materials designated under the Consolidated MHSW program is obligated to register, file reports on the materials supplied for sale or use in the Ontario market and remit fees to Stewardship Ontario.
The designated materials that are for sale or use in the Ontario marketplace are:
· Into the residential and all industrial-commercial-institutional (IC&I) sectors:
o all batteries (excluding lead acid batteries from vehicles)
· Into the residential sector only:
o pharmaceuticals (including prescription drugs, natural health products and over-the-counter medications)
o sharps including syringes
· Into the residential and IC&I small quantity generator sectors
o aerosol containers
o portable fire extinguishers
o fluorescent light bulbs and tubes (limited to generators of no more than 5kg/month)
o switches that contain mercury
o mercury containing measuring devices (e.g., thermostats, thermometers, barometers and other measuring devices)
o paints and coatings and their containers
o solvents and their containers
o lubricating oil containers with a capacity of 30 litres or less
o used oil filters
o antifreeze and its containers
o pressurized containers
o fertilizers, fungicides, herbicides, insecticides and pesticides and their containers
o flammable materials (e.g., fuel, kerosene, cleaners, strippers, propane, etc.)
o corrosive materials (e.g., muriatic, sulphuric acids; cleaning products, drain openers, paint remover, etc)
o toxic materials (e.g., adhesives such as contact cement, glues, epoxies, wood
o reactive materials (e.g., materials that explode such as Isocyanate foams and metal
o leachate toxics (e.g., materials that upon extraction produce an extract containing a toxic substance)
For a more complete list of product examples for each material type, please refer to the Rules for the Consolidated MHSW Program, Schedule A at page 133 of the Consolidated Municipal Hazardous or Special Waste Program Plan.
Please note that a number of materials designated under the MHSW Program may no longer be supplied for sale or use in Ontario (e.g., mercury switches and mercury-containing measuring devices). These are referred to as ‘obsolete’ waste. Stewards of obsolete materials are still obligated to register with Stewardship Ontario, even though they have ceased to supply this material for sale or use in Ontario. Also please note that if a company supplies for sale or use in Ontario a product that contains any of the designated materials, will be an obligated steward under this program.
Key milestone Dates that are Important to Stewards
Register to get information directly: next month Stewardship Ontario will open a registration page so that companies can provide the name and coordinates of the person in the company who should be the primary contact for communication. Please go to the Stewardship Ontario website (www.stewardshipontario.ca) regularly to access the registration page (in October) and to get updates on what is required to fulfill your obligation under the Waste Diversion Act, 2002.
March 31, 2010: by the end of March 2010, obligated companies are required to file a report with Stewardship Ontario detailing the quantities of all designated products supplied for sale or use in Ontario in 2009. Stewardship Ontario will open up an on-line reporting system for this purpose. Existing Blue Box and MHSW Phase 1 stewards will be familiar with this process.
Important Information for Stewards: The Consolidated MHSW Program Plan contains a preliminary schedule of material fees. It is expected that many of these fees will be amended based on the 2009 sales data provided by stewards by March 31, 2010. The recalibrated fees for all material categories will be provided to stewards before the program begins on July 1, 2010.
July 1, 2010: is the official start date of the new Consolidated MHSW program. This is the date on which Stewardship Ontario collection and recycling services will include the additional materials that are encompassed by the consolidated program.
July 31, 2010: by the end of July 2010, all stewards of designated products (listed above) will be required to file their first steward report based on the period April 1–June 30, 2010. Steward reports and fees will be due quarterly after that. The actual payment calculation will be based on one-quarter of the 2009 Annual MHSM Stewards’ Report (required to be filed at the end of March 2010). At the end of 2010, Stewardship Ontario will reconcile both years.
What is the Consolidated MHSW Program?
The Consolidated MHSW program is a waste collection and diversion plan to keep certain household and special wastes out of landfill. These are wastes designated as municipal hazardous or special waste under the Waste Diversion Act, 2002and Regulation 542/06.
The MHSW program sets clear and aggressive targets that will establish Ontario as the leading jurisdiction in North America for the management of municipal hazardous or special waste including the commitment to increased collection and recycling.
Stewardship Ontario is an industry organization that operates the MHSW program on behalf of Waste Diversion Ontario, an agency created by the provincial government to oversee a range of waste diversion programs authorized under the Waste Diversion Act.
